On Page 4 of Attachment 2.03.8 -1, Legal Description of the NH 1 mine: "Range" and square <br />footage of the permit area have been corrected as requested. However, there remain two items to <br />be addressed: the page mistakenly refers to the "1C" permit. Please delete the "C ". In addition, <br />Mine 1 lies exclusively within Section 25 (not 36 or 31), Township 47 (not 46) North, Range 16 <br />West. Please provide the correct Section and Township. <br />Rule 2.04.3 General Requirements: Site Description and Land Use Information <br />Previously resolved. <br />3A. Table of Contents was revised to delete reference to two unnecessary supplemental aerial photo <br />map exhibits. Item Resolved. <br />44A. Previously resolved. <br />4A -1. In this item, the Division had requested replacement of the term "farmland" with the more <br />broadly inclusive term "agricultural land ", within the text of Section 2.04.3, subsections 2.0 and <br />3.0, where the tern was used to apply to both irrigated cropland and irrigated pastureland. <br />Proper clarifying changes were made. However, in the 6 th paragraph of subsection 3.0, the term <br />"agricultural land" was substituted for "farmland ", where the latter tern was used in a specific <br />context and should not have been changed. The 2 nd sentence of the amended paragraph notes <br />that soils on the Morgan property are "prime agricultural land soils ". The correct reference in <br />this context is "prime farmland soils ". Please revise the sentence to properly refer to prime <br />farmland soils. <br />4A -2. Narrative clarification regarding the distinction between IPH and IP was provided as requested. <br />Item Resolved <br />4A -3. Various clarifying changes were made as requested to Map 2.04.3. Item Resolved <br />Rule 2.04.9 Soils Resource Information <br />4B. a. As requested, a current version of the NSSH Chapter 657.5 (please provide a notation that <br />this version has an effective date of January 1, 2000), which provides the NRCS criteria for <br />prime farmlands, was provided as revised Attachment 2.04.9 -4. However, a previous version <br />of NSSH Chapter 657.5 was (apparently erroneously) included at the very end of Attachment <br />2.04.9 -3 ( "Taxonomic Unit Descriptions "). Please address this apparent error and remove <br />the version of Chapter 657.5 from Attachment 2.04.9 -3 as warranted. <br />In addition, the Division had requested the operator to include a cautionary statement, noting <br />that any outdated documents included as attachments are being included in the permit <br />package for historical reference only. One such outdated document is included as <br />Attachment 2.04.9 -5. In the table of contents listing of attachments for Section 2.04.9, the <br />cautionary statement is included but is improperly written as two sentences rather than a <br />single sentence... "Contains erroneous data and should be used. For Historical purposes <br />only." This same improperly worded statement is included as a notation on the cover sheet <br />
