C- 1981 -008 August 25, 2010 <br />PR -06 AR #5 Page 18 of 26 <br />In addition, monitoring based on I S1 cut harvest bale weight and count will be conducted, and <br />the results will be included along with the relative production assessment results, in the <br />annual reclamation report submitted to the Division for the year. A sample of bales will be <br />weighed, with bale selection and weighing procedures to be consistent with procedures for <br />final bond release, with the exception that sample size will be a minimum of 6 for large bales <br />( >500 pounds) and a minimum of 15 for small bales (<100 pounds). Attainment of sample <br />adequacy is not required. The estimated hay production will be reported in pounds per acre, <br />based on average bale weight, total bales in the subject fields, and acreage of the subject <br />fields. <br />b. The Division requested certain clarifications regarding reporting of interim monitoring of <br />cropland hay production, and the requested modifications were provided. Item Resolved <br />c. The Division requested clarifications regarding IP and DP interim monitoring to be <br />conducted in Years 1 and 7 of the liability period. Modified language was provided, but we <br />suggest the following clarifications. In the first paragraph of Subsection 7.0, references to <br />sampling in the first two sentences should be replaced with monitoring. In Item A, at the <br />beginning of the first sentence, insert Based on representative sampling or visual evaluation, <br />assess species composition... <br />d. Requested clarification was provided regarding IP reclamation baled hay production interim <br />monitoring. Item Resolved <br />50. Previously resolved. <br />NEW ITEMS <br />50A. In the first sentence of Subsection 1.0 of Section 2.05.4(2)(e), there is reference to "the <br />amendment area ", which is undefined. Please delete the entire clause "and the amendment area" <br />and end the sentence with "New Horizon 2 area ". <br />50B. In Subsection 3.0, narrative in the second and third paragraphs indicates that the area of land to <br />be reclaimed to irrigated use is less than was originally irrigated due to reevaluation of water <br />availability. The narrative should note that the reduced acreage in irrigation also reflects WFC's <br />preference to reclaim most of the lands they own to the west of 2700 Road as dryland pasture <br />rather than irrigated pasture. <br />50C. In Section 3.0, narrative pertinent to land tracts described as Parcels 1, 2, and 3 make reference <br />to "original classification by Peabody as Irrigated Pasture ". These parcels located north of BB <br />Road and west of 2700 Road were not included in the Peabody permit area or vegetation study <br />areas. Also, although the parcels were predominantly irrigated pastureland and irrigated pasture <br />hayland, they included smaller acreages of rangeland. Please update the narrative as warranted. <br />50D. Regarding Tract 1 (the Benson West parcel) narrative, language in the final bullet point indicates <br />that grading of the entire site would be done so as to facilitate irrigation across the whole <br />property. Due to steep slopes on portions of the acreage, it would be more accurate to state that <br />site grading would allow for future irrigation across a major portion of the property (as explained <br />in the paragraph following the final bullet point).
