Climax is therefore authorized to proceed with the proposed quarry operations. This decision is <br /> based on the terms and conditions of permit amendment AM-03 approved in 1997, which states that small <br /> ancillary disturbances within the area of affected land would not require additional permitting whereas significant <br /> new disturbances within the area of affected land may have to be incorporated into the mine plan through the <br /> appropriate revision process. As was done in this case, the best way to assure compliance with the terms of the <br /> permit relative to ancillary disturbances is to consult with the Division on a case by case basis. <br /> The Division has reviewed the Notice of the proposal to manage various structural fill materials through burial at <br /> several locations around the Climax Mine site. This Notice was also provided in your letter dated August 11, <br /> 1999. The structural fill materials proposed for burial include inert foundation concrete and parking lot asphalt to <br /> be buried in the Storke Yard. This component of the Notice is acceptable to the Division. The Notice also <br /> describes a proposal to dispose of concrete tailing pipe adjacent to the Robinson Tailing Pond and at the toe of 3- <br /> Dam. Since these locations will in effect result in co-disposal of tailing pipe with mill tailing, this component of <br /> the Notice is also acceptable. However, if concrete tailing pipe were to be disposed of in locations not proximal <br /> to the tailing ponds, the Division would require a discussion or demonstration of the pipe's inert nature relative to <br /> the presence of any tailing residue on the pipe. <br /> If you have any questions, please contact me. <br /> Sincerely, <br /> Allen C.
