OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Topsoil, Reclamation Plan <br />PROBLEM: <br />During the inspection, it was discovered that there is little to no topsoil stockpiled at the site, which would be used for reclamation of the <br />site. This is a problem related to 3.1.9 (1) of the Construction Materials Rules and Regulations, for failure to remove and segregate <br />topsoil from other spoil and/or a problem related to 34-32.5-116 of the Colorado Revised Statutes, for failure to perform the prescribed <br />reclamation plan. <br />CORRECTIVE ACTIONS: <br />a. Submit a map indicating where topsoil is stored at the site, if any, and document the amount of topsoil stored in each stockpile along <br />with photographic documentation of the piles. <br />And/Or <br />b. If the County finds they have insufficient topsoil, they will need to import the proper amount of growth medium into the site. To <br />allow this, the Operator must file a Technical Revision to the reclamation plan to account for this activity. The Technical Revision must <br />include a backfill notice as described in Rule 3.1.5 (9) and outlined in the body of the inspection report.
