I have marked the same with a yellow <br />marker on the enclosed property map. <br />The names of the surface owners of record within 200 foot of the proposed mining <br />area would be Hiner Construction. The Cache La Poudre River is the southern <br />boundary of the land and Bucklin Equipment owns land to the south of the river. <br />There are two structures within 300 foot of the proposed mining area: <br />DCP Midstream has the Strong 6-31 well pipeline which leaves the well site <br />and goes east to the east property line of Hiner's property. I have <br />enclosed a signed Damage Waiver Agreement between R M Hiner Construction <br />Company Inc and DCP Midstream. <br />Xcel Energy has an overhead electric line within 300 foot of the proposed <br />mining area which provided electricity to.former mining batch plants in <br />years past. In.the fall of 2009 Xcel Energy did an electric relocation <br />at the expense of Hiner Construction to move electric poles, lines, ect. <br />back to the-current location which is past 200 foot of the proposed mining <br />area. Hiner Construction is, still awaiting the receipt of the signed <br />Damage Waiver Agreement from Xcel Energy and upon receipt, will forward <br />to your -attention. <br />The existing roadway will be used to :access the area and I have marked the map <br />with orange marker showing this existing roadway. <br />The material extraction will be from the south-southwest direction to the north- <br />northeast direction. Stockpiling of topsoil, ect. will be north of the proposed <br />mining area, south of the north 40 acre lakes south boundary, marked green on map. <br />The proposed mining area is on the east end of the south 21.2 acre lake, marked <br />pink on map, approximately 300 feet north/south and 600 foot east/west. We will <br />leave!,a dike along the present end of the lake approximately 50 foot wide and <br />dig that portion last. We anticipate the mining period to take 2 to 3 years to <br />complete and reclamation of the area another 3 to 4 years to total probably 7 to <br />8 years. This work will all be done as one phase.
