OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Gen. Compliance With Mine Plan <br />PROBLEM: <br />The operation appears to be inactive and appears to have been inactive for longer than 180 days. This is a problem at this time for <br />failure to provide the proper notice of Temporary Cessation of production to the Division and failure to obtain approval for such <br />inactivity. Pursuant to C.R.S. 34-32.5-103 (11) (b) <br />CORRECTIVE ACTIONS: <br />The operator will need to do one of the following options: <br />1.) Initiate mining <br />2.) Submit a Notice of Temporary Cessation as outline in Rule 1. 13.5 (2) for an initial five years of cessation. (Fee required is <br />$144) <br />3.) In accordance with Rule 1.13.17, submit a Technical Revision to the approved mining plan to allow for periods of inactivity <br />for longer than 180 days. This revision will also need to include all the information required for a notice of Temporary Cessation as <br />outline in Rule 1. 13.5 (2). (Fee required is $216) <br />4.)
