Pineda <br />Director <br />This item is in regards to a Notice of a Possible Violation, Cease and Desist Order, Corrective Actions and <br />Civil Penalties for a possible violation of C.R.S. 34-32.5-109 (1) for failure to first obtain from the Board or <br />Office a reclamation permit prior to engaging in a new operation. <br />CHRONOLOGY: <br />June 8, 1995 - the Division of Reclamation, Mining and Safety (Division) issued the Construction <br />Material Limited Impact (110) permit, M-1995-023, for the site to Merlin J. and Shirley F. <br />Peterson. <br />• August 19, 1989 - the permit was transfered to Corkle Construction through the Succession of <br />Operator (SO-01) process. <br />• July 19, 2010 - the Division conducted an inspection of the site. The site was GPS <br />surveyed with a Trimble Geo XT by the Division. <br />o The Corkle Pit is permitted for 9.9 acres of disturbance. <br />o The approved permit states, fencing will be installed along the west, south and <br />east permit boundaries.
