PERMIT #: M-1995-023 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: August 18, 2010 <br />OBSERVATIONS <br />The Corkle Pit, File No. M-1995-023, was inspected by Peter Hays and Tony Waldron with the Division of <br />Reclamation, Mining and Safety (Division). Mr. Hughie Corkle was present during the inspection. This <br />inspection was a follow-up inspection to the July 19, 2010 inspection to discuss the possible violation cited <br />during the previous inspection and to discuss possible solutions with the Operator. <br />During the inspection, Mr. Corkle stated Corkle Construction wanted to correct the permit boundary issue and <br />agreed to resolve the possible violation by way of a consent agreement with the Division. The consent agenda <br />will require Corkle Construction to submit a 110 to 112 Construction Material Conversion Application to <br />include at minimum the currently fenced 13.7 acre area, submit all applicable revised exhibits, maps and fees as <br />required by Rule 1. 11, and pay a civil penalty of $1000. The consent agreement will be sent under separate <br />cover. The Colorado State Land Board is the landowner for the site. Corkle Construction has a lease for 80 <br />acres south of Highway 14. Corkle Construction may choose to use the conversion application to expand the <br />permit boundary beyond the currently fenced area. <br />Division staff reviewed the permit file for the Corkle Pit at Corkle Construction's office following the <br />inspection to determine if the boundary fence discrepancy was resolved while the pit was permitted to the <br />previous permittee. The Corkle office file was consistent with the information on file with the Division and <br />confirmed the Division's finding during the previous inspection. <br />Mr. Harry Corkle stated in a phone conversion prior to this inspection the fuel tank noted in the last inspection <br />was empty and therefore did not require the containment berm to be lined or the volume to be verified to be <br />110% of the tank capacity. <br />Stockpiled material was being removed from the site during the inspection.
