Piheda <br />8120 Gage St. Director <br />Frederick, CO 80516 <br />RE: Heintzelman Project (Pit 116); DRMS File No. M-2009-018; Technical Revision - 01 <br />Dear Mr. Jones, <br />The Division of Reclamation, Mining and Safety (Division) received Technical Revision - 01 <br />(TR-01) for the above referenced permit on August 16, 2010. The request to establish a conveyor <br />system between the Heintzelman Project (Heintzelman) and the Kurtz Resource Recovery & <br />Land Development Project (Kurtz) through a Technical Revision has been de? nied'"The Technical <br />Revision was denied because the proposed changes require a Permit Amendment. Rule 1.1(6) of <br />the Construction Materials Rules defines an amendment as a change in the permit which <br />increases the acreage of the affected land, or which has a significant effect upon the proposed <br />Reclamation Plan. <br />The proposed conveyor route between the Heintzelman and Kurtz sites will span three (3) <br />separate permit boundaries and will cross Weld County Road 28. The Division considers the <br />conveyor route to be affected land. Therefore, the portion of Weld County Road 28, where the <br />conveyor crosses, must be included in the Heintzelman permit boundary through an amendment. <br />In addition, a Technical Revision must be submitted for the Kurtz site (M-1999-006) and the Nix <br />Sand & Gravel Mine (M-2001-046). The Technical Revisions for the Kurtz site and the Nix Sand <br />& Gravel Mine shall include, at a minimum, the following: <br />1. Revised Mining Plan Map(s) - showing the exact location of the conveyor route. <br />2. Revised Financial Warranty Cost Estimate - addressing the cost to remove the conveyor <br />system. <br />3. Revised Reclamation Plan - addressing the reclamation of the conveyor route. <br />4. Design drawings and specifications for the conveyor system. <br />5. Technical Revision fee of $216.00. <br />The amendment for the Heintzelman site shall include, at a minimum, the following: <br />1.
