STATE OF COLORADO <br />DIVISION OF RECLAMATION, MINING AND SAFETY <br />Department of Natural Resources <br />1313 Sherman St., Room 215 <br />Denver, Colorado 80203 <br />Phone: (303) 866-3567 <br />FAX: (303) 832-8106 <br />August 24, 2010 <br />Mr. Joe Gagliano <br />L.J Development Inc. <br />256 north Merrill DR. <br />Pueblo West CO 81007 <br />Re: M-1977-219, Summit Brick and Tile, Fox # 1 pit TR # 1 Adequacy. <br />Dear Mr. Gagliano <br />COLORADO <br />D I V I S I ON OF <br />RECLAMATION <br />MINING <br />SAFETY <br />The Division had reviewed your technical revision that was submitted on August 11, 2010, addressing <br />the concerns raised in the inspection report dated May 26, 2010 and has the following comments. <br />1) The operator proposes to change the maximum lineal feet of the high wall from the current <br />1,570 feet with a maximum height of 25 feet to 1,962 feet with a maximum height of 45 feet. <br />2) The operator also proposes to eliminate the phased mining and affect the total of 40 acres to <br />be affected through the life of mine. Total permitted acreage is 48. <br />Since the technical revision did not include an updated warranty for the site, even though the current <br />total affected acreage according to your submittal is 25 acres, the Division would like to know, does the <br />operator want to post warranty for the entire amount of acres to be affected for the life of mine? Is the <br />current proposed height of the high wall going to be stable as proposed? No engineering study was <br />provided to support your conclusions. Granted the Division did not observed and slope failure of the <br />high walls during the site visit, however, some sort of an engineered explanation supporting the <br />conclusions is desired. Please provide an explanation.
