These properties were <br />apparently incorporated into the permit later, under MR-51 in October 2001, and are currently owned by Benson. <br />Permit Section 2.03.6, Right-of-Entry (beginning on page 28 of Attachment 2.03.6-1), includes a January 1995 lease for <br />60 acres of Benson property located in Section 36 (west of 2700 Road). Given that Benson now owns the former Reeder <br />and Garrett parcels, the,permit should be revised to include documentation that Western Fuels has right of entry to the <br />entire 80-acre "Benson-West" property. <br />Please submit an application for a Minor Revision to the New Horizon Mine permit to incorporate proof of right-of-entry <br />for the 20 acres formerly owned by Reeder and Garrett. <br />Let me know if you have any questions or concerns. <br />Sincerely, <br />Marcia L.
