Pirieda <br />Director <br />Thank you for submitting your annual fee and report for 2010. However, C.R.S. 34-32.5-116(3)(a) and (b),1989 Supp. and <br />Permit No. M-1985-085 require you to submit to the Division of Reclamation, Mining and Safety (Division) $791.00 in <br />annual fees and an annual report on or before April 17th of each year. The Division has not received your annual fees and <br />report that were due April 17, 2009. Therefore, you are in violation of the above cited statute and the provisions of Permit <br />No. M-1985-085. Pursuant to C.R.S. 34-32.5-124 the Mined Land Reclamation Board hereby assesses Notice of Violation <br />No. MV-2010-022, civil penalties in the amount of $791.00, and Notice and Order to Cease and Desist from ALL mining <br />related activities associated with Permit No. M-1985-085. <br />NOTE: NO PERMITS FOR NEW MINING OPERATIONS SHALL BE GRANTED TO ANY OPERATOR WHO IS <br />CURRENTLY FOUND TO BE IN VIOLATION IN THIS STATE (C.R.S. 34-32.5-120) UNTIL THE VIOLATION IS <br />ABATED. The annual report and fee requirement is not met until we have received the following components: fee, report, <br />and associated man. If no new disturbances or reclamation have occurred during t_he previous year and no new changes to <br />the previous year's map are necessary then no new man is required provided that the Operator shall state this in the annual <br />rekort. <br />If you fail to submit the 2009 Annual Fee, 2009 Annual Report, and the civil penalties assessed by September 23, 2010, this <br />matter will be heard at a Formal Public Hearing before the Mined Land Reclamation Board for consideration of permit <br />revocation and forfeiture of the following warranty at the October 13-14, 2010 Board Meeting: <br />Bond Type(s) <br />CD <br />Bond Number(s) <br /> <br />Bond Amount(s) <br />$25,000.00 <br />If you submit all past due annual fees, reports, and the civil penalties by September 23, 2010, this matter will be withdrawn <br />from further Board consideration. <br />IN ORDER TO AVOID POSSIBLE PERMIT REVOCATION AND BOND FORFEITURE, PLEASE SUBMIT <br />$791.00 FOR PAST DUE ANNUAL FEES AND $791.00 FOR CIVIL PENALTIES ASSESSED FOR A TOTAL OF <br />$1,582.00, BY SEPTEMBER 23, 2010. <br />The Board Meeting will be held on October 13-14, 2010, in Room 318 of 1313 Sherman Street, Denver, Colorado, <br />beginning at 9:00 a.m. or as soon thereafter as the matter can be considered, and you will have the opportunity to be <br />represented and heard. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Arrlva and inarti- M;noc
