NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, Mining and Safety proposes to Withdraw Technical Revision <br />Application No. 78 (TR-78) for the Colowyo Coal Mine (Permit No. C-1981-019), submitted by <br />Colowyo Coal Company L.P. The Colowyo Coal Company has submitted a Technical Revision for the <br />Colowyo Mine to construct a temporary sump and three temporary ditches in the Prospect drainage area <br />of East Pit of the mine. The purpose of this revision is to help slow and decrease the runoff from the <br />drainage area to the Prospect Pond. The submittal of this complete revision fulfills the requirements of <br />abatement 5 of Notice of Violation CV-2008-004. There is no proposed change to the mine's disturbance <br />boundary or permit boundary with this revision. There will not be any increase in the mine's reclamation <br />liability as a result of this revision. <br />The Colowyo Coal Mine is a surface coal mine located in Moffat County, approximately 28 miles south <br />of Craig, Colorado. Coal interest is Federal, and the surface affected is Federal, state and private land. <br />The permit area encompasses approximately 12,250.95 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., <br />and the regulations promulgated thereunder. <br />Copies of the proposed decision, including stipulations, are on file for public inspection at the Colorado <br />Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 Sherman Street, <br />Denver, Colorado 80203. Persons with an interest that may be adversely affected by the proposed <br />decision may request a formal hearing before the Mined Land Reclamation Board on the proposed <br />decision. Such request must be made within ten (10) days of the initial publication of this notice, must be <br />in writing, and must state with reasonable specificity the reasons for the request and the objections to the <br />proposed decision.
