The Colorado Division of Reclamation, Mining, and Safety (Division) has reviewed and found the above referenced
report to be in compliance with the following regulations:
4.05.9(14)(b) - The impoundment has been maintained as designed, in accordance with the approved
plan and the applicable regulations.
4.05.9(15) - Certified inspection reports... shall include: Any appearance of erosion, instability,
structural weakness or other hazardous conditions.
4.05.9(17) - All impoundments shall be examined at least quarterly, by a qualified person designated
by the operator, for appearance of structural weakness and other hazardous conditions.
4.05.9(17) - A copy of the report shall be submitted to the Division on a quarterly basis.
The second quarter sediment pond inspection reports were received by the Division on July 30, 2010. Sediment pond
inspections were conducted by TMI between June 17 and June 29, 2010.
From the inspection reports, the identified maintenance items include: repair of the riser for No Name #4, repair of dam
erosion at West Pyeatt #1, sediment removal in East Pyeatt #1 and Oak #l, replacement of the sediment marker in West
Flume, and filling of burrows on the face of the Industrial Waste Pond. Per my inspection this week (August 18, 2010),
the maintenance of West Pyeatt #1 and East Pyeatt #1 has been completed.
Per the report, all ponds were functioning as designed at the time of the inspections.
