Jared Dains
South Platte Combined Replacement Plan
August 17, 2010
Page 2
Based on the above, this SWSP will only recognize 1,330 acre-feet per year of consumable water.
The current lease for the Graham Seepage & Drainage Canal water is for the period of May 1, 2010
through October 31, 2010 and is attached to this letter.
The proposed depletions and replacements are shown in the attached amended Division 1
Water Accounting Summary.
Conditions of Approval
I hereby approve this substitute water supply plan, in accordance with Section 37-90-137(11),
C.R.S., subject to the following conditions: _
1. All conditions listed in the original SWSP approved for the Aggregate South Platte Combined
SWSP on December 21, 2009 remain in effect except as modified herein. A copy of the original
approval is attached for your reference. This amendment does not alter the approval period of
this plan, which is May 1, 2010 through October 31, 2010 unless otherwise revoked or modified. If
this. plan will not be made absolute by a water court action by the plan's expiration date, a renewal
request must be submitted to this office with the statutory fee (currently $257/pit) for each gravel
pit no later than November 15, 2010.
2. The applicant will not utilize the 240 shares of the Boyd & Freeman Ditch in this plan since
measuring and recording devices will not be installed on the Boyd and Freeman Ditch and you
proposed to use augmentation credits leased from Graham Ditch Company instead.
3. The Water Commissioners responsible for the administration of this plan are Scott Edgar,
George Varra, Shera Sumerford and Bob Carlson. The applicant shall maintain daily records of
all diversions, replacements, and the amount of water used for each particular purpose. The
applicant shall provide a report of these records to the division engineer and the water
commissioners on a monthly basis on a form approved by them. The accounting must be
submitted within thirty (30) calendar days of the end of the month for which the
accounting is being made. Failure of the Applicant to provide timely accounting to the
water commissioners may result in revocation of this SWSP.
In addition, the applicant shall submit a report from each entity making replacements; for this
plan, those entities are the City of Westminster, City of Thornton, City of Greeley, Platte River
Power Authority, Centennial Water and Sanitation District and the Graham Ditch Company.
The report shall include an accounting of all wastewater plant water effluent controlled by each
entity, showing the total volume of water under its control at the various wastewater treatment
plants, and the amount committed to each of the recipients of the water. The applicant must
submit the required reports to the water commissioners on a monthly basis. If the
applicant does not submit the required reports the SWSP cannot be administered and
credit for the released effluent will not be granted.
