OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Financial Warranty <br />PROBLEM/POSSIBLE VIOLATION: Probable Violation: The financial warranty has not been maintained to reclaim the site in <br />accordance with the approved reclamation plan, and Norbel Credit Union refuses to honor the sight draft as required. This is a failure to <br />maintain a financial warranty in good standing for the life of the permit pursuant to C.R.S. 34-32.5-117(6)(a) of the Act. Also possible <br />violation of C.R.S. 34-32-117(2) for failing to comply with the performance warranty as required. An RTB Letter was sent to the <br />operator on July 16, 2010. <br />CORRECTIVE ACTIONS: The operator shall submit adequate financial warranty, as determined by the Division or reclaim the site <br />by the MLRB hearing on Sept 15, 2010. <br />CORRECTIVE ACTION DUE DATE: 9/15/10 <br />INSPECTION TOPIC: Signs & Markers <br />PROBLEM/POSSIBLE VIOLATION: Problem: The affected area boundary markers are missing or incorrectly placed. This is a <br />problem for failure to maintain boundary markers around the affected area as required by Section 3.1.12(2) of the rule. <br />CORRECTIVE ACTIONS: The operator shall replace the boundary markers in the correct location(s).
