Cc <br />C -81 -019 <br />To Whom It May Concern, <br />Colowyo Coal Company L.P. is submitting an application for Phase I and II <br />Performance Bond Release on parts of its 1993 -2003 reclaimed areas. Phase I <br />bond release includes an evaluation of the backfilling and grading to the approved <br />post- mining topography, as well as the establishment of permanent drainages. <br />Phase II bond release focuses on vegetative cover and species composition, in <br />support of the approved post- mining land use. In addition, Phase II requires <br />. Colowyo to demonstrate that the contribution of suspended solids to streamflow or <br />runoff is not in excess of pre- mining levels or levels documented for comparable <br />non -mined areas. Approval of topsoil replacement depths is the final major <br />component of Phase II bond release. <br />This written notice is sent to you pursuant to Colorado Division of Reclamation, <br />Mining and Safety ( CDRMS) Rule 3.03.2(1).
