Is there anything we need to provide you to authorize this activity? All of the equipment
will be mounted on skids or other temporary structures, and any piping will be above ground (except where it
will cross the road) and will be temporary pending installation of the more permanent unit by July 31.
We will be talking with the Radiation folks Tuesday to discuss licensing issues.
If we need to send you something please use Randy Whicker as the contact point.
Thanks
John S. Therefore, the Division acknowledges that by July
3, 2010 it will provide interim authorization of the proposed treatment and discharge (as described below and in
your attachment from Whetstone Associates), through an enforcement process associated with Notice of
Violation/Cease and Desist Order, Number I0-100601-1.
Such authorization will be term limited and will terminate upon notice or issuance of the developing Colorado
Discharge Permit System permit.
It should be anticipated that the interim authorization will include a uranium limit of 30 ug/L and interim limits
for other applicable parameters (comparable with the current permit) that are determined to be protective of the
beneficial use classification and stream standards associated with Ralston Creek. Monitoring and reporting
requirements will also be comparable to the current permit.
Please take note that an approved license will also be necessary from the Department's Hazardous Materials and
Waste Management Division (Radiation Program) and you should consult independently with the Department
of Natural Resources, Division of Reclamation Mining and
Safety for any requirements or needed approval from their agency.
