CO 50111
Attention: Randy Whickcr, Radiation Safety Officer
Re: Colorado Radioactive Materials License Number Colo. 369-06
.•?p co
N ?F.?%
J876
Colorado Department
of PublicHealth
and Environment
The Colorado Department of Public Health and Environment, Hazardous Materials and Waste
Management Division's Radiation Management Unit has issued Specific Radioactive Materials License
(Colo. 369-06) to the Cotter Corporation for the possession and storage of source materials accumulated
and sorbed to ion exchange media as a result of water radionuclide removal treatment being performed
at the Schwartzwalder mine site. This License (Colo, 369-06) does not include the requested transfer of
decommissioning and reclamation liabilities for areas or facilities that were previously radiologically
impacted as a result of activities performed under Colorado radioactive materials license number 369-
03.
The issuance of this license is in support of the Department's effort to ensure the protection of the water
quality of Ralston Creek and in turn the protection of public health and safety for the citizens of
Colorado who may draw upon the waters of Ralston Creek for a portion of their drinking water supply.
The Division has also provided a waiver to the source material 'general license possession limitation, of
15 lbs. at any one time, to Water Ren.ediation Technology, LLC for the period of July 1 through 31,
2010, so that an interim water treatment system could be operated facilitating Cotter Corporation's
compliance with the Colorado Department of Public Health and Environment's Water Quality Division
issued Notice of Violation/Cease and Desist Order (Number: 10-100601-1). The Division has further
endeavored to facilitate Cotter Corporation's eon.pliance with this order by issuing License Number
369-06 which allows for the accumulation, possession and storage of the source material residuals which
result from the more permanent water treatment system. that is required by Order Number: 10-100601-1.
