Pineda <br />, Director <br />RE: M & G Pit (Pollyanna Mann), DRMS File M-1986-079; Technical Revision # 8 <br />Dear Ms. Johnson: <br />This letter is written in response to your letter dated July 1, 2010 requesting that Lafarge not be <br />required to submit an amendment to Permit M-1986-079 to fulfill the requirements for approval of <br />Technical Revision No. 8. As you know, upon receipt and review of TR-8, the Division intended to <br />require that this revision be re-submitted as an amendment. However, the letter requiring this change <br />was never mailed; therefore, Lafarge was never notified of this deficiency. Furthermore, since Lafarge <br />was not notified of this change and in fact not contacted with notice of any deficiencies within 30 days <br />of submittal of the revision, TR-8 was approved automatically. Contained in the automatic approval <br />letter for TR-8 was a requirement for Lafarge to make new application for submittal of the amendment. <br />Upon further review, I have determined that submittal of an amendment to fulfill the requirements of <br />TR-8 is not necessary at this time as the changes included were appropriately addressed through the <br />existing technical revision process. <br />However, with respect to the M&G Pit in general, there may still be some unresolved issues with <br />exposed ground water that could require the future submittal of a technical revision or an amendment <br />to this permit. In accordance with the Division's April 30, 2010 letter sent to all operators with exposed <br />ground water, depending on the existing status of those sites, there may be some compliance <br />requirements that must be addressed by April 30, 2011. Gaining compliance with the requirements <br />outlined in the Division's letter could trigger the need to modify the permit through submittal of a <br />technical revision or amendment to the permit. In light of the requirements outlined in that letter, the <br />M&G pit status should be reviewed to determine if additional permitting may be necessary. <br />Please contact me with questions at 303-866-3567 ext.-8150. <br />Sincerely, ly, <br />Antho .
