Martin <br />Executive Director <br />Loretta E. Pifieda <br />Director <br />We have received your application for a technical revision to your permit to conduct coal mining in Colorado. Our initial <br />review indicates that all preliminary items required by Rule 2.08.5(4) have not been submitted. Thus, your application is <br />incomplete for the purposes of filing as of August 13, 2010. <br />The slide remediation plan provided in the revision application includes removal/reclamation of an existing road segment that <br />has been directly impacted by ground movement. The impacted segment (southern end of Road J, northern end of Road K, and <br />a short "Connector Road" segment between the two) was planned for permanent retention to provide necessary postmining <br />access for private landowners with holdings further south. The plan makes reference to a new road section that would be <br />constructed to replace the slide impacted segment, and depicts portions of the proposed road on plan view maps submitted on <br />the application. The Division has determined the revision to be incomplete because the plan does not include necessary design <br />and construction details for the proposed road pursuant to Rules 2.05.3(c) and 4.03, nor does the application designate the <br />proposed road corridor as "Disturbed Area" on the pertinent maps and the application form pursuant to Rule 1.04(36). An <br />amended application with the additional proposed disturbance area indicated on the application form, proposed amended <br />disturbance area depicted on revised maps, and plans that address the requirements of Rules 2.053(c) and 4.03 will need to be <br />provided in order for the application to be deemed complete. <br />In order to minimi delays associated with the slide remediation project, the Division requests that the amended revision <br />application be submitted by September 13, 20I0. <br />In accordance with Rule 2.07.3(1), you have the opportunity to amend, review, or otherwise make your application complete. <br />If you have any questions, please contact me. <br />Sincerely, <br />Da ' T.
