renewal was submitted by CAM Mining, LLC on May 2, 2007. A Proposed Decision and <br />Findings of Compliance for Permit Renewal No. 5 (RN -05) were written by the Division on <br />December 17, 2007 with conditions. Stipulation No. 34 required that "within 30 days of <br />issuance of the RN -05 proposed decision and prior to issuance of the RN -05 renewal permit, the <br />operator will submit an acceptable replacement reclamation bond or rider to the existing surety <br />bond, to bring the total bond amount held by the Division to at least $263,445.00 ". On January <br />7, 2008 the operator complied with the stipulation prior to issuance of the renewal permit. On <br />January 28, 2008 the Division approved the-permit renewal for another five -year term expiring <br />on January 13, 2013. <br />Since the permit renewal issuance date of January 28, 2008 for RN -05 there have been no <br />Notices of Violation issued. One technical revision (TR -23), two minor revisions (MR -35 and <br />MR -36), and one bond release (SL -1) were submitted and processed since the RN -05 permit <br />renewal. The recent permitting actions are summarized below in Section. II of this document. <br />SECTION II — REVISIONS TO THE PERMIT <br />The following is a summary of the revisions to the permit since the Permit Renewal No. 5 <br />Findings Document dated December 17, 2007, <br />Bond <br />No. Subject Decision -Date Adjustment <br />TR -23 As -Built Recl. Contours & Channel Specs. AP- 1124/2008 <br />MR -35 Update Adj. Landowners at Loma Loadout AP- 9/18/2008 <br />MR -36 Incorporate Drainage Channel Profiles AP- 11/4/2008 <br />SL -01 Partial Phase I Bond Release AP- 2/2312009 - $145,860.00 <br />SECTION III -- STATUS OF STIPULATIONS <br />Since the submittal of the original permit application there have been a total of thirty -four <br />stipulations issued. All but one of these stipulations have been terminated or complied with as <br />described below. Stipulation No. 34 was added with the Permit Renewal No. 5 Proposed <br />Decision and Findings of Compliance on December 17, 2007. Stipulation No. 34 required that <br />"within 30 days of issuance of the RN -05 proposed decision and prior to issuance of the RN -05 <br />renewal permit, the operator will submit an acceptable replacement reclamation bond or rider to <br />the existing surety bond, to bring the total bond amount held by the Division to at least <br />$263,445.00 ". On January 7, 2008 the operator complied with the stipulation prior to issuance of <br />the renewal permit. Prior to this midterm review (MT -6) there were two active stipulations <br />(Stipulation No. 12 and Stipulation No. 32). Stipulation No. 12 addresses raptor buffer zones <br />and remains in effect. Stipulation No. 32 addresses the requirement for documentation of surface <br />Munger Canyon Mine -4- August 10, 2010 <br />
