Horvath Pit No. 1, File No. M-1977-546, Technical Revision No.2 (TR2) Denial Retraction <br />Dear Mr. Lyman: <br />On July 20, 2010 the Division of Reclamation, Mining and Safety (DRMS) denied your request for a Technical Revision (TR2) <br />for the Horvath Pit No. 1, addressing the following: <br />• To change the post-mining land use from pastureland to a gravel surfaced equipment storage site. <br />After further discussion, with yourself and the landowner (Brice Lee) regarding final reclamation of this site during the <br />August 4, 2010 inspection, I would like to retract the denial of TR2 and suggest revising the TR2 request. It is the <br />determination of DRMS that the final reclamation proposed by TR2 for the site will not change the post-mining land use and <br />will not require an Amendment to the permit. The revised request should address removal of the stockwater pond from the <br />Reclamation Plan. Also, please submit another letter from Mr. Lee with the revised TR2 request authorizing this change to <br />the Reclamation Plan as the landowner. <br />Additionally, a revised reclamation cost was included with the original TR2 submission.
