status update at the Board's August 11-12, 2010 meeting. If the parties resolve <br />pending matters, they will withdraw the above regulatory actions on or before <br />the Board's August 11-12, 2010 meeting. If the parties cannot resolve pending <br />matters, the parties anticipate setting all of the regulatory actions on the <br />Board's September 2010 meeting <br />(2) The parties agree to conduct an initial pre-application meeting no later than <br />July 30, 2010, and any additional pre-application meetings no later than August 10, <br />2010, to list the outstanding issues and establish a specific timeline and conditions for <br />resolution of the issues including ones -pertaining to a conversion application. If the <br />parties are not able to reach resolution of pending issues and no other alternatives are <br />found, the parties will so report to the Board at its August 11-12, 2010, meeting and this <br />stipulation shall become null and void on August 12, 2010 at S p.m. and each party shall <br />be restored to its position as of June 30, 2010 without further order or action by the <br />Board. <br />(3) Wildcat Mining will file a conversion application to convert its current 110 <br />permit at the May Day Mine to a 112 pen-nit that will cover all current and anticipated <br />affected land at both the May Day Mine site, Idaho Mill and the Idaho Mine site (the <br />"Conversion Application"). The Conversion Application will be deemed complex and <br />a designated mining operation provided as follows: <br />(a) Wildcat Mining may seek exemption from designated mining operation <br />requirements at a Board hearing pursuant to Rule 7.2.6; <br />(b) The Division agrees that any ground water quality data, or surface water <br />quality and flow data, that may be required to be collected pursuant to Rules 6.4.20(9) <br />or (11) shall be collected following permit issuance; the parties agree that, mining may <br />not commence until Wildcat Mining submits appropriate and adequate hydrologic <br />information to the Division and the Division approves the information as a permit <br />modification; provided, however, subject to the Division's prior approval, Wildcat <br />Mining may do certain limited mining activities that will not affect surface water <br />quality or ground water quality. <br />(c) At the pre-application meeting, the parties will discuss any on-the-ground <br />work that Wildcat Mining may conduct prior to permit issuance but subject to <br />2
