Compliance With Mine Plan NA - Support Facilities Not On-site <br />R - Other NA - Special Categories Of Mining <br />NA - Processing Waste R -Topsoil <br />COMMENTS <br />This was a complete inspection of the Colowyo Mine conducted by Jim Stark of the Colorado Division of <br />Reclamation, Mining and Safety. The inspection was conducted on 19-22 July 2010. Ryan Pawlowski and <br />Jennifer Sekulski of Colowyo accompanied me on different portions of the inspection. The weather was warm and <br />sunny during most of the inspection and the ground was mostly dry. Colowyo did receive rain on the night of 21 <br />July 2010 but that did not create and problems getting around. <br />AIR RESOURCE PROTECTION - Rule 4.17: <br />- The South Taylor Haul Road and the haul roads in the West Pit and South Taylor Pit were creating some dust but <br />Colowyo was actively watering the roads at the time of the inspection. <br />- Colowyo has applied magnesium chloride to several of the haul roads in the West Pit area to help control dust. <br />BACKFILL and GRADING - Rule 4.14 <br />Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Highwall Elimination <br />4.14.1(2)(f); Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials 4.14.3; Stabilization of Rills and <br />Gullies 4.14.6: <br />- Colowyo has not completed any additional backfilling and grading at the site since the spring of 2010 (around <br />March 2010). <br />- Colowyo has completed approximately 90 acres of backfilling and grading in the West Pit. In addition to this 90 <br />acres there is also a block of approximately 35.6 acres that were backfilled and regraded in 2007 and 4.4 acres that <br />were backfilled and regraded in 2009 that did not have the topsoil replaced. These areas will have the topsoil <br />replaced and they will be reseeded this year as well. The total acreage in the West Pit that will be topsoiled and <br />reseeded in 2010 is approximately 130 acres. To date Colowyo has completed approximately 145.7 acres of <br />backfilling and grading in the West Pit. In the approved backfilling and grading plan (Map 29) Colowyo has <br />committed to complete 675.8 acres of backfilling and grading by the end of 2012. Based on the amount of <br />backfilling and grading that has been completed to date, Colowyo will need to complete approximately 530.1 acres <br />of backfilling and grading in the West Pit in 2011 and 2012. <br />Number of Partial Inspection this Fiscal Year: 1 <br />Number of Complete Inspections this Fiscal Year: 0 <br />Page 2 of 13
