August 5, 2010 <br />Mr. Jared Ebert /m? <br />Division of Reclamation, Mining & Safety AGGREGATE <br />1313 Sherman Street, Room 215 <br />INDUSTRIES <br />Denver, CO 80203 <br />Re: Permit No. M-1989-120 - Platte Valley Operation <br />TR-03 - Groundwater Monitoring Wells - Adequacy Review Response <br />Dear Jared: <br />Aggregate Industries (AI) is submitting this letter in response to the Division's July 20, 2010 <br />adequacy review of the above-referenced technical revision. The responses are numbered <br />according to the items listed in the July 20 letter: <br />1. Monitoring and Reporting Requirements <br />Monitoring of the groundwater wells installed at the Platte Valley site will be conducted <br />by Molen and Associates, LLC on behalf of Patrick Broda under Colorado Department of <br />Public Health and Environment (CDPHE) regulatory authority and will commence upon <br />CDPHE approval of the water quality monitoring plan submitted to that agency. Al <br />commits to supplying the results of the groundwater monitoring data to the Division as <br />part of the annual reclamation report as requested in the Division's May 13, 2010 <br />inspection report. <br />2. Moundine and Shadowing Impact <br />As Al does not propose to backfill the entire pit excavation it is unlikely that there will be <br />any significant ground water mounding or shadowing impacts to adjacent lands. An open <br />water pond will still exist between the backfill area and the river and there would be no <br />shadow effect to the strip of land between the pond and the river. Additionally, any land <br />that would lie within the areal extent where shadowing would typically be expected, i.e. <br />downgradient of the backfill area, is land owned by Al and within the permit area. <br />While AI also does not expect that the backfill activity will result in ground water <br />mounding impacts to adjacent lands, AI does commit to measuring ground water levels to <br />provide data that would assist in evaluating any future alleged mounding impacts by <br />adjacent property owners.
