The Division of Reclamation, Mining and Safety (Division) has reviewed the content of Castle Rock
Construction Company of Colorado, LLC 111c permit application for the Vick Borrow Pit, File No. M-
2010-048, and submits the following comments. The Division is required to make an approval or denial
decision'no later than August 17, 2010 therefore; your response to the following adequacy review
concerns should be submitted to the Division as soon as possible.
Exhibit L - Permanent Man-Made Structures (Rule 6.3.12):
1. The applicant states in Exhibit B the fiber optic line is owned by Level 3. Mr. Lau, CDOT Project
Engineer, states the line is owned by Qwest in the Access Agreement letter dated July 21, 2010.
Please clarify who owns the fiber optic line.
2. Please revise Exhibits B, E and L to indicate Mountain View Electric Association, Inc. as the owner of
the overhead power line.
3. Please revise Exhibits B, E and L to indicate the owner of the fiber optic line (see question #1).
Exhibit I - Proof of Filing with County Clerk (Rule 6.3.9):
4. Please provide an affidavit or receipt indicating the date on which the revised application information
indicated above was placed with the local County Clerk and Recorder.
Please be advised the Vick Borrow Pit application may be deemed inadequate, and the application may
be denied on August 17, 2010 unless the above mentioned adequacy review items are addressed to
the satisfaction of the Division. If you feel more time is needed to complete your reply, the Division can
grant an extension to the decision date. This will be done upon receipt of a written waiver of your
