Pineda <br />Director <br />E/ <br />The Division of Reclamation, Mining and Safety (Division) has reviewed the content of Castle Rock <br />Construction Company of Colorado, LLC 111c permit application for the Vick Borrow Pit, File No. M- <br />2010-048, and submits the following comments. The Division is required to make an approval or denial <br />decision'no later than August 17, 2010 therefore; your response to the following adequacy review <br />concerns should be submitted to the Division as soon as possible. <br />Exhibit L - Permanent Man-Made Structures (Rule 6.3.12): <br />1. The applicant states in Exhibit B the fiber optic line is owned by Level 3. Mr. Lau, CDOT Project <br />Engineer, states the line is owned by Qwest in the Access Agreement letter dated July 21, 2010. <br />Please clarify who owns the fiber optic line. <br />2. Please revise Exhibits B, E and L to indicate Mountain View Electric Association, Inc. as the owner of <br />the overhead power line. <br />3. Please revise Exhibits B, E and L to indicate the owner of the fiber optic line (see question #1). <br />Exhibit I - Proof of Filing with County Clerk (Rule 6.3.9): <br />4. Please provide an affidavit or receipt indicating the date on which the revised application information <br />indicated above was placed with the local County Clerk and Recorder. <br />Please be advised the Vick Borrow Pit application may be deemed inadequate, and the application may <br />be denied on August 17, 2010 unless the above mentioned adequacy review items are addressed to <br />the satisfaction of the Division. If you feel more time is needed to complete your reply, the Division can <br />grant an extension to the decision date.
