I'd left you a voice-mail message earlier today asking you to <br />consider and suggest a few dates from the week of June 21 st and thereafter that would be convenient <br />for you to meet with us at your offices in Denver. If you would be available for a tour and to meet at <br />the West Elk Mine, you are very welcome, so let us know dates that would work for you in that case, <br />as well. <br />We are currently preparing additional information to show substantial support for our request to <br />vacate and will provide the request package to you a few days ahead of the meeting. As a primer to <br />this detailed package, attached is the letter that I'd sent in compliance with Rule 5.04.3(1) providing <br />preliminary written information in regard to the alleged violation. In addition, attached is the MR 365 <br />minor revision application that was submitted in compliance with the abatement steps required in the <br />NOV. The MR was approved and the NOV terminated a week ago by just adding the current mined <br />areas to the current, approved E-seam mine map.
