Environmental Protection Plan, Schwartzwalder Mine 4-1 <br />• 4. OTHER PERMITS AND LICENSES <br />Rule 6.4.20(5) requires that the EPP list any air, water quality, solid and hazardous waste, and other federal, <br />state permits or local licenses, or other formal authorizations which the Operator/Applicant holds or will be <br />seeking applicable to the use, handling, storage, or disposal of designated chemicals and acid mine <br />drainage-forming materials within the permit area. <br />The Schwartzwalder Mine operated under Colorado Mining Permit # M-1977-300, Colorado Discharge <br />Permit #CO-0001244 and Radioactive Materials License CO-369-03. <br />(a) Colorado Mining Permit #M-1977-300 <br />The mine permit (M-1977-300) was issued by the State of Colorado in 1977, and covers 57 acres of Section <br />25. The permit disturbance boundary covered by the permit is shown in Figure 2-2. <br />(b) Colorado Discharge Permit #CO-0001244 <br />Discharge Permit #CO-0001244 was issued in 1981 by the Colorado Department of Public Health And <br />Environment, Water Quality Control Division for the Schwartzwalder water treatment plant. The original <br />plant treated mine water to remove uranium and radium prior to discharge into Ralston Creek. This plant, <br />which included three in-line ion-exchange columns, has not discharged since June 30, 2002. The <br />Discharge Permit was renewed for the fifth time on April 1, 2005 and was effective through March 31, <br />2010. An application for renewal was submitted in the fall of 2009, and an administrative extension was <br />granted until renewal could be assessed and issued. A draft of a revised Permit CO-0001244 was posted <br />for public review on July 23, 2010. Renewal of this permit, revised to authorize a new discharge outfall <br />location and with new water quality discharge limitations, is expected by the end of August, 2010. In the <br />interim, authorization to discharge from the new 100-gpm ion exchange water treatment plant to Ralston <br />Creek at the new discharge outfall location (001A) has been granted by the Water Quality Control Division <br />under a temporary amendment to a June 1, 2010 NOV/Cease and Desist Order (order #I0-100601-1). The <br />treatment system is described in Section 15(b) and the permit discharge limits are discussed in Section <br />11(a)(i) of this EPP. <br />(c) Radioactive Materials License number CO-369-03S <br />The Radioactive Materials License #CO-369-03S was issued by the CDPHE Hazardous Materials and <br />Waste Management Division and is valid for five years. The permit had been renewed every five years <br />since it was first issued. Renewal of this Radioactive Materials License has been in abeyance since 2005, <br />though annual effluent monitoring and reporting requirements have remained in effect. No activities <br />involving licensed radioactive materials have taken place during this time. This license is in the final <br />stages of decommissioning and final termination is expected by the end of 2011. <br />(d) Radioactive Materials License number CO-369-06 <br />A new Radioactive Materials License #CO-369-06 was issued by the CDPHE Hazardous Materials and <br />Waste Management Division on July 29, 2010. This license authorizes storage, possession and ownership <br />of radioactive materials associated with an ion-exchange water treatment system that has been installed in <br />the former water treatment facility building for purposes of groundwater remediation. Operation of this <br />water treatment system is authorized under radioactive materials services provider license #CO-1177-01 <br />held by Water Remediation Technology (WRT). Operation of the ion exchange water treatment system <br />will be performed by WRT under their approved radiation safety program. <br />is <br />4109C.100731 Whetstone Associates 6
