our visit, we did not observe any signs of instability, structural weakness or hazardous conditions at the <br />pile. It should be noted that the internal roadways in the pile, as well as the haul road were in good <br />condition. The drainage's along the roadways may have to be cleaned or regarded after runoff from the <br />spring is completed. <br />The stripping of the topsoil and cover materials in the refuse pile expansion area had also continued during <br />this quarter. Bower Brothers Construction had continued stockpiling the topsoil and cover materials in the <br />southern and eastern portions of the site. Bower Brothers Construction had also placed the drain rock to <br />near the existing pond, situated at the north end of the expansion area and had also placed the filter I and 11 <br />materials in this area to a point approximately 30 to 40 feet west of the pond. <br />As suggested, the water levels in the monitor wells installed on October 23, 1997 and December 9, 1999 <br />were measured during this quarter on a monthly basis. A table and graphs showing the monthly water <br />levels are attached. It should be noted that the subcontractor used to measure the water levels in the <br />monitor wells did not provide the June data to TCC until after the first week of July. Due to a technical <br />error, NWCC did not receive the monitor well information from TCC until July 28, 2010. Therefore, TCC <br />submitted a request to the State of Colorado for an extension to submit this report on August 2, 2010. <br />We were advised that the wash plants had produced approximately 68,535 tons of waste coal during the <br />month of April 2010: approximately 78,773 tons during May 2010: and approximately 104,413 tons during <br />June 2010. It is our understanding that the fines being produced at the wash plant, which consists of <br />approximately 10 to 20 percent of the total materials being produced, are being pumped underground into <br />the mine. <br />Based on our limited observations, it appears that the pile is currently being constructed and maintained in <br />general accordance with the project specifications and plans submitted under 2.05.3(8) and that the <br />potential hazard to human life and property at the site in its present condition is minimal.
