"The noise from the proposed Gravel Pit would exceed 50 decibels at the Gill and Santee property <br />lines and 30 decibels at a distance of 'a mile away." <br />The jurisdiction of the Board and DRMS does not extend to land use decisions, visual or <br />economic impacts, noise, traffic, dust not caused by eroding berms or spoils piles, or other <br />nuisances or socioeconomic issues. The health, safety and welfare of the Neighbors stand to be seriously affected by the proposed <br />pit. Gravel pits produce tremendous levels of dust, most notably crystalline silica, which has been <br />designated as a Level 1 carcinogen... These facilities also emit hexavalent chromium, another <br />known carcinogen." Smith for the Eagle Mtn. Pit, File No. M-2010-019 has met the <br />requirements of the Colorado Land Reclamation Act for the Extraction of Construction Materials and <br />the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for the Extraction <br />of Construction Materials. <br />It is the recommendation of the Office that the Board approve this 112c permit application without <br />stipulations pursuant to CRS 34-32.5-115(4). <br />Page 7 of 7
