Pay Dirt, Notice of Intent (NOI) Application, Reference No. P-2010-019, Review and <br />Decision date. <br />Dear Mr. Allred, <br />The Division of Reclamation, Mining, and Safety (DRMS) has received your application for a Notice of <br />Intent (NOI) for prospecting. A pre-operational inspection will be done on August 3, 2010 as DRMS staff <br />will be in the area. DRMS notes that a check for $86.00 was submitted with each Forms 1 and 2. Staff is <br />returning one of the checks as the fee is $86.00 for the Notice application not for each form. <br />An initial review notes a few issues that need clarifications or corrections. Please address the following: <br />1. Please confer with the landowner and identify the desired post-disturbance land use. It is noted <br />the site is pre-disturbed. You will be responsible for reclamation of areas you disturb. This <br />includes stockpile footprints, excavated and traffic areas. <br />2. Based on the post disturbance land use submit a seed mix to accomplish vegetation of the site. <br />You mentioned a grass field or pasture as a possibility. Any local CO-OP will have a typical seed <br />mix for such purposes. DRMS will need to know the composition of the mix: species of grasses, <br />pounds live seed (PLS) per acre applied, etc. <br />3. You note the desire to place some gravel on two sections of the access road for repairs. DRMS <br />has no issue with the repairs. An issue would arise if significant upgrades to the road were <br />undertaken such as graveling the entire road, widening it, placement of culverts or bridges, etc. <br />4. It is noted that you have supplied water rights decreed to the landowner. The rights are noted <br />for irrigation water use. DRMS cautions the applicant to contact the local water authority to <br />ensure that the use of the decreed water for mining purposes is appropriate. Issues have arisen <br />in the past in certain areas over the use of irrigation water for commercial / industrial purposes. <br />5. Please verify that no process water will be discharged into the San Miguel River or its tributaries <br />The use of the existing sedimentation ponds appears to be acceptable so long as all waters are <br />infiltrated and not discharged. <br />6. Based on the submitted plans it is not discernable if sedimentation controls are necessary <br />around the disturbance area. Please identify any areas (if any) that may need sedimentation <br />control such as hay bales or silt fencing. <br />7.
