M-1980-146 ?M-4- <br />RESPONSE- TO COMMENT #6 (26 JUL 2010) <br />Dear Mr. Oswald: <br />This letter is the response to the subject comment letter received electronically <br />yesterday. The corrected memorandum from the BLM will be submitted separately. <br />Otherwise, we believe that this letter and its attachments address all concerns in the <br />subject comment letter. <br />General: <br />As requested, the written scale shown on all revised maps has been removed, <br />and only the graphical scale is now shown. <br />The small signatures on several of the revised maps has been replaced by a <br />larger signature. <br />The permit number has been corrected where necessary. <br />The first page of the actual permit application form has been corrected to show <br />the new acreage, and is attached. <br />2. Exhibit D - Mining Plan (related to Exhibit C, Mining Maps): <br />Exhibit E - Reclamation Plan: <br />a. It is my professional opinion that there will be no offsite impacts to the <br />Crader Pit, provided that the mining and reclamation as described in <br />Exhibits C to F is performed as described. The material being mined is a <br />conglomerate which is stable at the natural slopes present in the vicinity, <br />and the proposed post-mining and post-reclamation slopes are flatter <br />than those naturally occurring on the site; so there are no "unstable <br />slopes" proposed - unless conditions are found to be much different than <br />those already found to the north and south of the boundary between the <br />two pits. <br />b. Since the logical method, as described, is to daylight between the two <br />pits, the slope of the area on both sides of the boundary will be NOT <br />STEEPER than the 3:1 shown on the mining maps in Exhibit C, and is <br />anticipated to be much flatter, although it is not possible at this time to <br />determine precisely what that grade will be. <br />C. Since the proposed grading of the southern portion of the Montoya Pit, as <br />shown in both the mining and reclamation plan, shows the entire mined
