• Mobile Mill Area <br />The soil and vegetation characterization provided above for the Tailings Impoundment Area apply here, as well. <br />The exception being there are no abandoned waste rock piles here and there is an increased occurrence of Rock <br />Outcrop. Also, the natural grade in this vicinity is less steep averaging 5h : I v. <br />6.3.2(b) <br />Permanent Man-Made Structures: <br />Historic Mining Roads, Public Right of Way <br />Within this vicinity there are numerous historic mining roads that traditionally have public right of way. Clear <br />Creek County designates these roads as a Secondary #4 roadway: <br />Secondary #4 Roads falling into this category have a wide variety of road surfaces and provide <br />ingress/egress for the traveling public. These roads include; roads which are declared public <br />highways pursuant to CRS 43-2-201 and R-98-181 by the BOCC, and plated dedicated roadways <br />in existing subdivisions which do not meet road design specifications. These roads are open and <br />public roadways but are not included in the Road Mileage Tax System of the state of Colorado. <br />Most of these roads are traversable by four wheel drive vehicles only. These roads receive no <br />snow removal, but may be periodically repaired by the Road and Bridge Department at the <br />direction of the Board of County Commissioners. <br />There is a road segment that crosses the abandoned waste rock dump at the upper end of the proposed <br />Tailings Impoundment Area. This road already crosses the dump and is subject to a high degree of erosion. <br />After construction of Impoundment Bench #5, this road segment will be preserved to a more stable <br />configuration to allow for continued use. In no way will this road segment be eliminated. <br />• Venture Resources finds it particularly amusing that Clear Creek County expresses concern over this road <br />in their earlier correspondence. In fact, Clear Creek County Planning Department led a campaign in July <br />2008 to legally vacate a portion of this road, rendering it non-usable and inaccessible (reference CCCPD <br />case #RD 2008-0001). Ultimately, the adjacent landowners pushed back and stopped it from occurring. <br />Funny how such things are forgotten ... or, positions are reversed when it suits a particular agenda. <br />Clear Creek County actually has passed a Resolution on how to address when a historic right-of-way <br />becomes blocked. The landowner could re-route the right-of-way around the obstruction on their property <br />or eliminate the obstruction (reference BOCC R-98-181 & R-99-77). <br />Refer to the maps in Exhibit A & E as well as a stability analysis in Exhibit L. <br />Private Electric Utility Distribution Lines <br />There is approximately'/4 mile of 25kV overhead electric utility distribution within the Ownership <br />Boundary shown in Exhibits A and E. This line is PRIVATE, solely owned by Venture Resources Inc. and <br />is not necessarily used specifically for mining operations. Xcel Energy provides primary metering at the <br />point of connection. on Two Brothers Rd. at the Virginia Canyon Rd. switchback. <br />6.3.2(c) <br />Water Resource Description: <br />Surface Waters <br />Clear Creek is located 2,800' to the south and 1,000' in elevation below the Tailings Impoundment affected area. <br />Drainage from this area follows down Hukill Gulch. Historically, the drainage from this vicinity contains acid- <br />runoff/drainage from the numerous abandoned mine waste rock piles and adits located throughout this gulch. Many <br />of these sources are not within the control of Venture Resources (ie Colorado School of Mines owns over a dozen <br />Page 2 of 4
