Pit, File No. M-2010-019, Notice of Pre-Hearing Conference and Formal Board Hearing <br />Regarding the Construction Materials Regular (112) Operation Reclamation Permit Application Submitted <br />by Thomas H. Smith <br />To whom it may concern: <br />The Colorado Division of Reclamation, Mining and Safety (DRMS) have received a formal objection to the above <br />referenced application. Therefore, pursuant to Rule 1.4.9, staff has scheduled the matter for hearing before the <br />Colorado Mined Land Reclamation Board (MLRB). The hearing will occur during the August 11-12, 2010 Board <br />meeting at the Centennial Building, 1313 Sherman Street, Room 318, Denver, Colorado, 80203, commencing at <br />9:00 a.m. on August 11, 2010 or as soon thereafter as the matter can be considered. Parties and interested <br />persons will have an opportunity to be heard. <br />A Pre-hearing Conference has been scheduled to occur on July 30, 2010, beginning at 12:00 p.m. The conference <br />will be held at the Pagosa Springs Ross Aragon Community Center, 451 Hot Springs Boulevard, Pagosa Springs, <br />Colorado, 81147, in the Arts and Crafts room. Ms. Sandra Brown will preside as Pre-hearing Conference Officer. <br />The purpose of the Pre-hearing Conference is to describe the office's review process, to explain the rights and <br />responsibilities of parties, to discuss and resolve issues to the extent possible, to describe the Board Hearing <br />processes, to determine and simplify the list of issues under the Board's jurisdiction, and to determine who has <br />demonstrated standing to be a party to the Formal Board Hearing. Please note pursuant to Rule 2.6 (2), parties <br />are required to provide thirteen (13) 3-hole punched copies of their list of potential witnesses and their <br />exhibits at the Pre hearing Conference Failure to do so may preclude use of witness testimony or exhibits at <br />the Formal Public Hearing. <br />After the conference, the Pre-hearing Conference Officer shall cause to be drafted a Pre-hearing Order. The Pre- <br />hearing Order will be mailed to all parties within 10 working days after the Pre-hearing Conference and will <br />contain a list of the parties, provide a recommended list of issues to be considered by the Board, and outline a <br />schedule for the hearing with time allotments set for presentations by each party and the Office. The conditions <br />of the Pre-hearing Order are not final until adopted or approved by the Board at the Formal Board Hearing.
