C-1981-008
PR-06
July 23, 2010
landowners as required by Rule 2.05.5(1)(b). The correspondence is found in Attachment
2.05.4(2)(e)-8. In the narrative for Subsection 3.0 please reference that the
correspondence with the landowners is in Attachment 2.05.4(2)(3)-8. For areas that are
being reclaimed to dryland pasture, WFC included a copy of the proposed seedmix. As
requested, WFC also sent letters to the landowners east of 2700 Road.
53. WFC provided the proposed irrigation plans in the letters to the landowners where irrigation is
proposed.
54. WFC has revised the discussion on irrigated parcels in subsection 3.0 of Section 2.05.4(2)(e) as
follows.
a. WFC has provided documentation using NRCS design criteria for the acre/share ratio for
postmine; irrigated pastureland areas using both sideroll irrigation and flood irrigation. The
irrigation designs are in Attachment 2.05.4(2)(3)-8 and 9.
Benson West - 79.76 acres. 44 shares of water. WFC proposes to flood irrigate 12.4
acres on Benson West and return 55.8 acres to dryland pasture. Part of the Benson
West: has not been disturbed. The remaining 31.6 shares of water are used to irrigate
Benson's property east of 2700 Road.
• Lloyd Property - 79.74 acres. 24 shares of water. WFC proposes to flood irrigate 25.62
acres and return 46.02 acres to dryland pasture. Part of Lloyd's property has not been
disturbed by mining.
WFC Property (originally Johnson Property) - 95.89 acres (was 57.6) 3.96 acres are
Prime Farmland that have been disturbed and will be returned to flood irrigated cropland
using 4 to 6" HDPE pipe from proposed pipe on southern end of property. 2.44 shares.
Proposed irrigation design is the same as Morgan flood irrigation in Attachment 2.05.,
although no specific designs shown for the WFC property. 91.93 acres will be dryland
pasture. Capability for future irrigation is discussed.
• Morgan Property - All 107.96 disturbed acres of the Morgan property have been
designated Prime Farmland. WFC is proposing to irrigate the reclaimed fields using at
least 62 shares of water. In the discussion under 4), the second bullet, please revise the
reference to the lease addendum letter for the additional water to say it is included in
Attachment 2.05.4(2)(e)-7.
• WFC Property in southeast part of permit area. 29.36 acres. Originally Irrigated
Pasture, the parcel will be reclaimed to Dryland Pasture because no water is available.
The land will be graded such that irrigation could occur in the future.
b. Resolved.
55. WFC has revised the narrative so that the change in post mining land use for the Dirk Richards
parcel located north of BB Road and immediately to the west of the NH-2 permit boundary is
discussed in. Section 2.05.4(2)(e) Subsection 3.1. Portions of this property were irrigated prior
to mining and originally designated as Irrigated Pasture, but they have been re-designated
dryland pasture due to the lack of available water.
