M-1980-146 V-1 -
RESPONSE TO COMMENT #5 (28 APR 2010)
References: RECEIVED
1. Letter, DRMS, 27 January 2010
2. Letter, DRMS, 28 April 2010 JUL 1 ?010
3. Letter, Wasteline, 17 March 2010
Dear Mr. Oswald:
Division of Reclamation,
Mining & Safety
This letter is the response, in part, to the reference #2, and includes restatements of the
• appropriate and corrected parts of the reference #3, as you requested. The right-to-
enter issue, and items related to that, are addressed in a separate submittal.
BLM Environmental Assessment:
All references have been removed, as requested. The rewritten sections from reference
#2 are provided here.
1. Exhibit C: Mining Maps.
These maps have been revised to show mining to be done in ONLY those portions of
Sections 3, 4 and 1 O.which BLM has currently agreed to allow C&J Gravel Products to
mine gravel in. All other land within the permit boundaries requested in this amendment
are identified as NOT being mined at this time. Therefore, we would need to submit a
revision to the permit in the future, if or when the current BLM lease agreement is revised
or superseded and these "possible mining" areas are allowed to be mined by BLM. See
revised Maps C1, C2, C3, and C4, attached. Map C5 is no longer needed. See also
Attachment B, the letter from BLM specifying that mining was allowed in Sec 4.
2. Exhibit E:
a. The seed mix is identified in Exhibit J (revised, Attachment C), and will be the same for
both BLM administered and privately-owned properties, and is the seed mix as presently
approved by BLM. BLM may change that mix at any time; if BLM does so, we will notify
the DRMS and change the mix to meet BLM requirements; if necessary by submitting a
. revision. Revisions may also be necessary to meet other BLM requirements, specifically
the following items required by the BLM's lease:
