Permit Application Package - Third Incompleteness
Dear Mr. Bell:
On July 21, 2010, the Division of Reclamation, Mining and Safety (Division) received your second Special 111
Construction Materials Reclamation Permit Application package incompleteness response for the Vick Borrow
Pit, File No. M-2010-048. The review of the information received determined the following items must be
received before the Division can consider your application as being submitted and technical review can begin:
1. Please provide completed copies, signed and dated, of Addendum 1- Notice as required by Rule 1.6.2(1)
(b).
6.3.9 Exhibit I - Proof of Filing with County Clerk
2. Please provide an affidavit or receipt indicating the date on which the revised application was placed
with the local County Clerk and Recorder.
6.3.12 Exhibit L - Permanent Man-Made Structures
3. The applicant provided an Access Agreement letter dated July 21, 2010 and signed by Roger Lau, CDOT
Region One Project Engineer in response to Items #4 and #5 of the Division's incompleteness letter
dated July 9, 2010. The Division will accept Mr. Lau letter in place of a structure agreement for the
CDOT right of way fence associated with the Vick Sand Pit. However, Mr. Lau's comments regarding
the overhead power line and underground fiber optic line must be addressed in greater detail as noted
below.
4. Please provide a notarized letter, on utility letterhead, from the owner (Level 3 or Qwest) of the fiber
optic line that the mining and reclamation activities, as proposed, will have "no negative effect" on
their utility.
5. The applicant states in Exhibit B the fiber optic line is owned by Level 3. Mr. Lau states the line is
owned by Qwest in the Access Agreement letter dated July 21, 2010. Please clarify who owns the fiber
optic line.
