Racine Director <br />Centennial, Colorado 80111 <br />Re: Vick Borrow Pit, File No. M-2010-048, Receipt of Special 111 Construction Materials Reclamation <br />Permit Application Package - Third Incompleteness <br />Dear Mr. Bell: <br />On July 21, 2010, the Division of Reclamation, Mining and Safety (Division) received your second Special 111 <br />Construction Materials Reclamation Permit Application package incompleteness response for the Vick Borrow <br />Pit, File No. M-2010-048. The review of the information received determined the following items must be <br />received before the Division can consider your application as being submitted and technical review can begin: <br />1. Please provide completed copies, signed and dated, of Addendum 1- Notice as required by Rule 1.6.2(1) <br />(b). <br />6.3.9 Exhibit I - Proof of Filing with County Clerk <br />2. Please provide an affidavit or receipt indicating the date on which the revised application was placed <br />with the local County Clerk and Recorder. <br />6.3.12 Exhibit L - Permanent Man-Made Structures <br />3. The applicant provided an Access Agreement letter dated July 21, 2010 and signed by Roger Lau, CDOT <br />Region One Project Engineer in response to Items #4 and #5 of the Division's incompleteness letter <br />dated July 9, 2010. The Division will accept Mr. Lau letter in place of a structure agreement for the <br />CDOT right of way fence associated with the Vick Sand Pit. However, Mr. Lau's comments regarding <br />the overhead power line and underground fiber optic line must be addressed in greater detail as noted <br />below. <br />4. Please provide a notarized letter, on utility letterhead, from the owner (Level 3 or Qwest) of the fiber <br />optic line that the mining and reclamation activities, as proposed, will have "no negative effect" on <br />their utility. <br />5. The applicant states in Exhibit B the fiber optic line is owned by Level 3. Mr. Lau states the line is <br />owned by Qwest in the Access Agreement letter dated July 21, 2010.
