Cmary <br />Ac i O" m Di Wor I <br /> a <br />The Division of Minerals and Geology (DMG) has reviewed your letter and attachments dated <br />September 24, 2002 proposing a temporary crossing over the Interceptor Canal to facilitate topsoil <br />stockpiling operations. As we have discussed, the Interceptor Canal is an Environmental Protection <br />Facility as defined in Rule 1.1(15) of the Hard RoclclMetal Mining Rules and Regulations of the Mined <br />Land Reclamation Board and is subject to the provisions of Rules 7 and 8. The installation of the <br />culvert and crossing will temporarily impinge on the flow capacity of the canal; your proposal includes <br />the contingency of culvert and crossing removal in the event of unusually large snowpack <br />accumulation. The Division hereby approves the temporary installation of the culvert and crossing <br />with the following condition applied as a clarification to the flooding contingency plan, <br />At the beginning of April and again at the beginning of May during each year that the <br />Interceptor Canal is impinged by the temporary culvert and crossing, the snowpack will be <br />evaluated by reference to the Jones Pass and Glen Mar Ranch (Summit Ranch) Snotel sites. If <br />the snow/water equivalent at either of these sites exceeds 125 percent of average, Henderson <br />will consult with DMG about the potential need to remove the temporary culvert and crossing <br />from the Interceptor Canal prior to intensive snowmelt runoff. This consultation may include a <br />requirement to model and estimate the flows in the canal that would result from snowmelt <br />anticipated based on the Snowtel data. <br />If you have-any questions, please contact me. <br />Sincerely, <br />Allen C.
