All' <br />Re: Permit M-1977-342, TR-13, Tempr orary Interce for Canal Culverts and Crossing, Henderson <br />Mill <br />Dear Mr. Sorenson: <br />Climax Molybdenum Company (CMC) is pleased to provide the following information related to Technical <br />Revision 13 (TR-13) of the Henderson Reclamation Permit. CMC is in the process of reviewing its DRMS <br />permit files to make sure that all associated commitments have been met and that the related files, <br />correspondence and authorizations are complete. As is practicable, our goal is to obtain written <br />confirmation that obligations associated with each of our technical revision and permit amendment files <br />have been satisfied. We believe this will prove useful to both CMC and DRMS, and we appreciate your <br />assistance with this effort. <br />A portion of TR-13 pertains to temporary upland interception ditch crossings. The Division conditionally <br />approved the TR with the following stipulation (see Attachment #1): <br />At the beginning of April and again at the beginning of May during each calendar year <br />that the Interceptor Canal is impinged by the temporary culverts and crossings, the <br />snowpack will be evaluated by reference to the Jones Pass and Glen Mar Ranch <br />(Summit Ranch) Snotel sites. If the snowAvater equivalent at either of these sites <br />exceeds 125 percent of average, Henderson will consult with DMG about the potential <br />need to remove the temporary culvert and crossing from the Interceptor Canal prior to <br />intensive snowmelt runoff. This consultation may include a requirement to model and <br />estimate the flows in the canal that would result from snowmelt anticipated based on the <br />Snotel data. <br />CMC has consistency complied with this condition. However, as DRMS is aware, since the inception of <br />this requirement, CMC completed construction of the "Ultimate" clean water (storm water) interceptor <br />canal. This new storm water collection system, which is operating as designed and performed admirably <br />during the 2010 spring run-off, eliminates the need for the temporary culverts/crossings and associated <br />snowpack data collection. <br />CMC requests that the DRMS send written acknowledgement that the above stipulation is no longer <br />applicable and, subsequently, that CMC is no longer required to collect snowpack data in the spring of <br />each year.
