.,e- <br />r <br />No surface disturbance is involved with the mining of the proposed Federal Indian lands permit <br />since all coal recovery will be via underground mining methods. All coal will be processed and <br />shipped via the new support facilities being built for the King II mine located on Colorado State <br />permit C-81-035. <br />Accordingly, National King Coal, LLC will be authorized to initiate underground coal mining and <br />reclamation operations within the approved boundaries of Federal Indian lands permit CO-0106A <br />upon resolution of the following permit condition; <br />Special Permit Condition 1, "Mining Plan Approval": <br />- Surface coal mining and reclamation operations on Federal permit CO-0106A may not <br />be initiated until the Assistant Secretary Land and Minerals Management approves a <br />Mining Plan Modification for Federal lease COC-62920. <br />Upon receipt of an acceptable reclamation bond the Manager, Program Support Division will issue <br />Federal Indian lands permit CO-0106A. <br />You may appeal this decision under the procedures set out in the Federal regulations under 30 <br />CFR Part 775 and 43 CFR Part 4. <br />For further information or clarifications concerning this approval, please contact me at (303) 844- <br />1400, extension 1500. <br />Sincerely, <br />Carl R.
