III. COMMENTS-COMPLIANCE Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.Jim Kiger represented the operator during the field inspection and records check. Signs and Markers The mine identification signs were up at the main entrance,east entrance and along the east side road near the railroad tracks. The required information was on each sign. Permit boundary markers were up around the site. Roads The paved entrance road was in good condition.The guard rail was up. The east side graveled entrance road was passable.The operator has begun locking up the east entrance gate.The track light use road was also passable. Hydrology The east side sediment pond was dry.The gated primary was closed and the emergency spillway was clear of any debris. Pond inslopes and the pond embankment had a good vegetative cover.The operator has placed a container with oil absorbent material next to the pond for use in case oil should enter the sediment pond.The west side pond also was dry.There was no blockage of the pond's open channel combination spillway. The collection ditches had sufficient capacity. The loadout culverts were clear of debris and sediment. Silt fence and straw bales were in place along the railroad track small area exemption. Topsoil Stockpiles The topsoil stockpile on the west side of the loadout had a good vegetative cover,although the cover vegetation is starting to turn brown on the south facing side of the stockpile.There was no problem with erosional gullying. The topsoil signs were up on the stockpile.The east side topsoil stockpile had a moderate vegetative cover. Signs were up on this stockpile as well. Facilities There was a fair volume of coal that had been stockpiled on the facilities bench. A coal haul truck was being loaded with coal fines for transport back to the Elk Creek Mine,where the coal had originated.There were no crushing or loading operations going on during the inspection.No problems with fugitive dust were observed. There were no problems with the coal handling structures, substation,loadout office and material storage area. The operator will be replacing the 6,000 gallon fuel tank with three smaller fuel tanks.There were no leaks at the fuel facility. In order to increase security,the operator will install a gate at the main entrance and place a row of large rocks on the east end of the site,next to the material storage area. With these measures and the locked east gate, access to the loadout will be controlled.
