III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.Jim Kiger represented the <br /> operator during the field inspection and records check. <br /> Signs and Markers <br /> The mine identification signs were up at the main entrance,east entrance and along the east side road near the <br /> railroad tracks. The required information was on each sign. Permit boundary markers were up around the site. <br /> Roads <br /> The paved entrance road was in good condition.The guard rail was up. The east side graveled entrance road was <br /> passable.The operator has begun locking up the east entrance gate.The track light use road was also passable. <br /> Hydrology <br /> The east side sediment pond was dry.The gated primary was closed and the emergency spillway was clear of <br /> any debris. Pond inslopes and the pond embankment had a good vegetative cover.The operator has placed a <br /> container with oil absorbent material next to the pond for use in case oil should enter the sediment pond.The <br /> west side pond also was dry.There was no blockage of the pond's open channel combination spillway. <br /> The collection ditches had sufficient capacity. The loadout culverts were clear of debris and sediment. Silt fence <br /> and straw bales were in place along the railroad track small area exemption. <br /> Topsoil Stockpiles <br /> The topsoil stockpile on the west side of the loadout had a good vegetative cover,although the cover vegetation <br /> is starting to turn brown on the south facing side of the stockpile.There was no problem with erosional gullying. <br /> The topsoil signs were up on the stockpile.The east side topsoil stockpile had a moderate vegetative cover. <br /> Signs were up on this stockpile as well. <br /> Facilities <br /> There was a fair volume of coal that had been stockpiled on the facilities bench. A coal haul truck was being <br /> loaded with coal fines for transport back to the Elk Creek Mine,where the coal had originated.There were no <br /> crushing or loading operations going on during the inspection.No problems with fugitive dust were observed. <br /> There were no problems with the coal handling structures, substation,loadout office and material storage area. <br /> The operator will be replacing the 6,000 gallon fuel tank with three smaller fuel tanks.There were no leaks at <br /> the fuel facility. In order to increase security,the operator will install a gate at the main entrance and place a row <br /> of large rocks on the east end of the site,next to the material storage area. With these measures and the locked <br /> east gate, access to the loadout will be controlled. <br /> Records <br /> The loadout records were in compliance,as documented on the attached records checklist. <br /> c:/word2007/terror/insp07l O <br />
