III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the <br /> operator,Bowie Resources LLC,during the field inspection. <br /> Unit Train Loadout <br /> There was no activity at the loadout,except for a concrete mixer truck. All three entrances were open,with mine <br /> identification signs up at each entrance. Surface disturbance markers were up around the disturbed area.The <br /> three paved entrance roads were in good condition.The collection ditch on the extreme west end of the loadout <br /> had sufficient capacity. The ditch's half culvert drop structure that brings the ditch water down to the track level <br /> was in place.The loadout's only topsoil stockpile was well grassed and the topsoil sign was up on the pile. <br /> There were no problems with the remaining facilities,railroad track and bridge. <br /> The centrally located upland diversion system was functioning properly.The ditches and culverts had enough <br /> capacity to safely channel upland flow through the loadout.The sediment pond was dry. The operator had <br /> removed the tree limb that had fallen into the pond's emergency spillway. The pond's bin wall was stable. The <br /> upland diversion ditch and culverts that channel upland runoff around the sediment pond were in place. <br /> Irrigation water was flowing in the Farmer's Ditch,which flows through a culvert beneath the sediment pond. <br /> Temporary Highway Coal Stockpile Area <br /> This site has been partially reclaimed.The mine id sign was up at the entrance while markers defined the surface <br /> disturbance area. The entrance road was passable.There were no railcars on site.The sediment pond was dry. <br /> The straw bales at the culvert inlet on the west end of the site will need some maintenance in the near future. <br /> The cut slopes were stable.A good vegetative cover was on the cut slopes. A moderate vegetative cover was on <br /> the flat area of the site. <br /> East Mine <br /> The entrance gate to the site was locked.The mine id sign was up on the fence.The sediment control ditches <br /> and straw bales at the entrance were in place.The dirt road leading from the entrance all the way to the top was <br /> in good condition. Several road culverts still need to be removed for reclamation.The backfilled and graded <br /> slopes were stable.No signs of slope instability and no erosional gullies were seen.Not all of the backfilled <br /> slopes have been seeded yet but the roughened surfaces were preventing gullies from forming. The road ditches <br /> and diversion ditches were in place and had sufficient capacity.The riprapped sections of the ditches were in <br /> place.The operator is continuing to repair silt fence and reinstall surface disturbance markers that had fallen <br /> during grading operations. <br /> Exploratory Well BV-2 <br /> The operator will be done with this exploratory well and the site reclaimed by the end of July. Topsoil had been <br /> stockpiled and a mud pit was being used for cuttings. The bottom section of the hole will be cored. <br /> c:/word2007/bowie 1/insp0710 <br />
