PERMIT #: M-1979-206 <br />INSPECTOR'S INITIALS: BMK <br />INSPECTION DATE: July 6, 2010 <br />OBSERVATIONS <br />The Division conducted a monitoring inspection of the site as part of sites to be inspected during the fiscal years 2010 <br />and 2011. The site is a small 112 construction materials permit covering 37.01 acres, which was mined pre-law. Operator <br />had attempted to rclaim the per- law sites and the reclaimed slopes and benches appeared stable. <br />Presnt during the inspection were Mr. Lonell and Mr Lionell senior, the opeartor. The site is located approximately 10 <br />miles west of Howard, Colorado. <br />Site was not active at the time of the inspection. When the site was inspected in 2003, no problem was noted. A financial <br />warranty was calculated at that time which estimated the cost to be $32, 500.00. According to Mr. Lionelle, the maximum <br />material that is mined out and exported from the site does not exceed 2,000 cubic yards. The current pit area was recently <br />shot to recover the gypsum. Even though listed as gypsum in the commodities list, it is more than likley a metamorphosed <br />evaporite.Mr Linolle, who is a geolgist and very familiar with the site, belives it to be as such. In looking at the material, <br />and given the areas active altreation zone, that concluion is supported. According to Mr Lionelle, all of the permit area is i <br />privately owned and no Federal land is involved.The permit system list as the prperty to be owned by both the federal and <br />private. Mr Lionelle stated that the federal lease does not cover the 37.01 acres of the current permit area. <br />The site was not active at the time of the inspection. However, as noted above, the active mining area covering two <br />benches was shot recently exposing the evaporite/ gypsum.The active bench and mining area extends north to south <br />covering approximately 150-200 feet in length and 20-25 feet high walls when all the material is recovered, and final <br />contour takes shape. Bench width measures approximately 12-15 feet in width. <br />The reclaimed slopes were found to be, stable and sparsely vegetated.Operator limits the affected area by reclamining as <br />the area being mined is completed. The current affcetd area is approximately 6 acres.The upper reclaimed benches and <br />high walls were found to be stable and sparsely vegetated. In 1999, 6 acres of the permit area were released. <br />Permit sign and boundary markers were properly posted.Operator brought the permit sign with him, and stated that <br />leaving it at the gate will only keep it in place until the next vandals get in to shoot guns. Even though the rule requires the <br />opeartor to place the posted sign at the gate, given the numerous times the site has been vadalized and the fact that the <br />Division noted the results of the vadalisim on site, the Division will grant the operator's request to bring the permit sign <br />and post it while the site is active and remove it at the end of the day. There were a lot of empty bullet shells noted at the <br />base of the pit with different kind of targets utilized by the vandals, even with a clearly marked no trespassing sign posted <br />at the access to the property . <br />Most of the drainage from the pit area which is very small is contained, with in the pit.
