Gilcrest Reservoir, LLC. owns these structures located within the permit area. Since the owner <br />of these structures in no longer the permittee, they must be accounted for with one of the three <br />options given in Rule 6.4.19 as outlined above. Or, the Applicant can provide evidence the <br />landowner has given the permittee permission to remove/demolish the structures they own <br />within the affected land. This could be a signed notarized letter from the landowner. <br />Publication and Notices <br />23.) The Division reviewed the certified mail receipts submitted in Attachment E for the public <br />notice procedures. There are several items that will need clarification: <br />A.) The Exhibit C map indicates Kristen Taufer and Lot Holdings Investments, LLC. owns <br />lands within 200 feet of the Affected Land. Where these two entities notified? If so, <br />please submit copies of the certified mail receipts. If not, they will need to be notified <br />and the given 41 days from the date of notification to comment on the application, in <br />which case the decision date for the application may need to be extended. Or submit <br />evidence the proper notice was served to these parties and a notarized letter from <br />these parties indicating they do not object to the proposed amendment application. <br />B) Also, the following individuals were notified, and it is unclear where their property <br />or easement is located on the Exhibit C map. Please explain, why each of the following <br />individuals were notified. If they are an adjacent landowner and/or an easement <br />holder, the location of their property/easment will need to be depicted on the Exhibit C <br />map. <br />1. Kenneth A Breitenback <br />2.
