July 14, 2010 X-2010-232-00/New Elk Mine 2010 Exploration Program KAG <br />GENERAL MINE PLAN COMPLANCE - Rule 2.02(g) and 4.21.2(2): <br />This was a coal exploration partial inspection conducted by Kent Gorham and Rob Zuber of the <br />Colorado Division of Reclamation, Mining and Safety. The weather on this day was hot and ground <br />conditions were dry. The Division received a Notice of Intent to explore involving 250 tons or less of <br />coal from New Elk Coal Company on May 14, 2010. <br />Rule 2.02.2(3) requires that the Division "review the complete notice of intent to conduct coal exploration <br />and shall make a determination within two weeks of the filing of such complete notice, whether the <br />proposed exploration will substantially disturb the natural land surface, and if so whether the proposed <br />activity qualifies as coal exploration or surface coal mining operations. The Division shall immediately <br />notify the person in writing of its determination. The determination of substantial disturbance shall be <br />made with reference to 1.04(127). If the Division determines that the proposed coal exploration activities <br />will substantially disturb the natural land surface, the person who intends to conduct such coal <br />exploration shall comply with 4.21." <br />Rule 2.02.2(7) states "No person shall conduct coal exploration activities under 2.02.2 until they have <br />received notification of the Division's determination on substantial disturbance and qualifications as coal <br />exploration." <br />The Division sent the <br />written determination <br />required by Rule 2.02.2(3) <br />on May 21, 2010. The <br />activities will create a <br />substantial disturbance and <br />does qualify as coal <br />exploration. <br />Rule 2.02.2(5) requires <br />that "a determination by <br />the Division that <br />substantial disturbance of <br />the natural land surface by <br />exploration with removal <br />of 250 tons or less will <br />require that the person <br />who proposes to conduct <br />Number of Partial Inspection this Fiscal Year: 0 <br />Number of Complete Inspections this Fiscal Year: 0 <br />Page 3 of 5
