PERMIT #: M-1980-112 <br />INSPECTOR'S INITIALS: THM <br />INSPECTION DATE: June 10, 2010 <br />OBSERVATIONS <br />This inspection was conducted as part of the normal monitoring program established by the Colorado Division <br />of Reclamation, Mining and Safety (Division). The Richard Bachman Pit is located 5.5 miles southeast of <br />Meeker, Colorado off of RBC Road No. 8. The site is a 112c operation. Scott Nielson, Ron Leeper, Van Pelo <br />and Clint Chappell all representing Rio Blanco County accompanied the inspector during the inspection. <br />The purpose of the inspection was to inform the Division that Rio Blanco County had misinterpreted the permit <br />area of the Richard Bachman Pit and stockpiles of wash sand were stockpiled outside of the permit area on <br />adjacent BLM land. The permit area was recently re-surveyed prior to the inspection. The corrected permit <br />boundary markers were placed in the correct location. It appeared that approximately + or - 1 acres of <br />disturbance was located outside of the permit boundary. <br />Due to the stockpiles of material located outside of the approved permit area the operator is out of compliance <br />with the approved reclamation permit. Normally this situation would be considered a Possible Violation but <br />considering that Rio Blanco County brought this matter to the Division's attention voluntarily and the <br />disturbance outside of the permit boundary was a result of misinterpretation of the original survey, therefore no <br />enforcement action will be taken before the Mined Land Reclamation Board. However, the mine related <br />disturbance outside of the permit boundary is considered to be a problem for failure to follow the approved <br />mining and reclamation plan. As a result, the corrective action required is for the operator to submit a permit <br />amendment to incorporate the mining related disturbance into the reclamation permit.
