(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1977-193 <br />INSPECTION DATE: 6/13!10 INSPECTORS INITIALS: _RK <br />OBSERVATIONS <br />The Division conducted a joint inspection of the site with Stephanie carter of ELM, which <br />owns the surface and mineral rights. This was also to full fill sites to be inspected <br />during the fiscal years 2009-2010.The site is very old 110 sand and clay mine located <br />approximately 3 miles east of Howard Colorado. Also present were the operators Ms. Pam <br />Wedige and Mr. Paul Ottoman. <br />Site was active at the time of the inspection removing clay from already stockpiled are, <br />utilizing front end loaders and haul trucks. <br />The entire area was walked and inspected. Part of the approved mining plan allowed the <br />operator to mine inside the dry gulch. At the bottom of the dry gulch is what is believed <br />to be a small shallow GW water fed wet area,(spring) which could fall under the <br />jurisdictional authority of the State Engineer. Given the very small nature of the spring <br />however leads one to believe, it is more than likely fed from a said precipitation event, <br />rather than a GW source. Since the operator has finished mining in this area and the <br />final bank slope of the gulch has already been established, impact to the prevailing <br />hydrologic balances considered negligible. The entire permit and affected area was walked <br />and inspected. Operator had reclaimed a portion of the affected area along the East and <br />north side. The current activity is along the south and west side. <br />Operator wanted to know how to expand the current permit area. The operators were <br />notified that the current site is permitted to affect 8 acres. Of which approximately 5 <br />acres appeared to have been affected. According to the operator the most they have <br />removed from the site is 2,000 cubic yards a year. <br />Until the current reclaimed site is released from further reclamation responsibility, the <br />maximum area that could be added to the current 110 permit is 1.9 acres. However, if the <br />operator wants to convert it into a 112 permit the acreage restrictions will be lifted <br />and the operator can apply for as many acres they want and only post warranty for the <br />acres they will affect. <br />Permit sign and boundary markers properly posted. As requested by ELM, only one of the <br />access roads is being utilized for the operation leading to the county road. <br />The current financial warranty for the site is more than adequate to cover the cost of <br />reclamation as approved in the 1977 permit. All of the affected drainage is captured with <br />in the current pit area. Bank slopes of the dry gulch were stable given the type of <br />material.
