III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
The spring, 2010 inspection was conducted primarily of the reclaimed areas located from the confluence
of Coal and Dutch Creeks,to the Lamp house. Areas above the lamp house were inaccessible due to
snow and mud.
All areas observed that have not been disturbed by the owner of the private property located within the
former permit area appear to have weathered the winter and early spring run-off well. Vegetation is well
established. Minimal erosion was noted on any of the reclaimed areas. Movement of sediment from
reclaimed areas was not observed.
Aspen Middle school had volunteered to plant trees as part of an eighth grade environmental science
class. Approximately 1,500 mixed species of trees were to be planted on the Sutey Refuse Pile the week
of May 17.
Maintenance of the upper portions of the site may be undertaken later in the summer,if conditions
warrant.
