Rule 4.09.2 - Excess Spoil <br />16. Response Partially Accepted. Colowyo has corrected the volumes for the East Taylor <br />and West Taylor Fills, as requested. Colowyo has provided a revised page South <br />Taylor/Lower Wilson-Rule 4, Page 20, which details the fill volumes. The Division has <br />corrections that need to be made on the revised page South Taylor/Lower Wilson-Rule 4, <br />Page 20. The following items will need to be corrected under Section 4.09 - Disposal of <br />Excess Spoil: <br />a. On the third line of the first paragraph Colowyo states that "...East and West <br />Taylor Fills and the temporary fill will remain at the conclusion of the project...". <br />The temporary fill material will not remain, as it will be used to backfill the South <br />Taylor Pit. Please remove the text that states "and the temporary fills". <br />b. On the fourth line of the second paragraph Colowyo states that the West Taylor <br />Fill will contain approximately 9.1 million yards of temporary spoil. The chart <br />for question 16 in the responses states that the temporary fill will contain <br />9,173,000 yards. This volume rounds to 9.2 million cubic yards. Please correct <br />the volume for the West Taylor Fill temporary spoil pile to 9.2 million cubic <br />yards. <br />c. On the fifth line of the second paragraph Colowyo states that there will be "...26 <br />million yards of out-of-pit spoil." Please add the word "permanent" ("...26 <br />million yards of permanent out-of-pit spoil.") to differentiate between <br />temporary and permanent spoil. <br />d. In the preliminary adequacy review letter the Division requested that Colowyo <br />include a chart of both the permanent and temporary spoil that will be associated <br />with each fill. Colowyo has not included this chart on revised page South <br />Taylor/Lower Wilson-Rule 4, Page 20. Please include a chart that shows both <br />the temporary and permanent spoil in the East Taylor and West Taylor Fills <br />on page South Taylor/Lower Wilson-Rule 4, Page 20. <br />17. Response Accepted. The chart of permanent spoil matches the text on revised page <br />South Taylor/Lower Wilson-Rule 4, Page 20. The Division has requested several <br />changes and additions to the text, which are detailed in question 16 above. <br />18. Response Accepted. Colowyo has revised both the mine plan and the post-mining <br />topography with the TR-81 responses. These changes have decreased the total amount of <br />permanent spoil for the South Taylor Fills <br />19. Division comments, 19a-f, are no longer relevant due to changes in the post-mining <br />topography submitted in the Colowyo response. Please note that the Colowyo maps and <br />cross sections were not found to be "confusing" to the Division, and no apology is <br />required. The Division's comment referred to a comparison of the proposed changes to <br />Map 20 in TR-81 to the currently-approved version of Map 20 (via TR-63 in June 2007). <br />In the initial submittal of TR-81, Colowyo did indeed propose a lowering of the post- <br />mining topography.
